Action in the Hennepin County District Court wherein plaintiff, against whom certain personal injury actions arising out of
an automobile collision had been brought, sought a declaratory judgment as to the liability of defendants Universal Underwriters,
Lynn Underwriting Company, and Motor Vehicle Casualty Company. Morten Arneson, owner of the car which plaintiff was driving,
was also joined as a defendant. Universal Underwriters and Lynn Underwriting Company had issued a liability insurance policy
to plaintiff, and Motor Vehicle Casualty Company had issued one to Morten Arneson. The case was tried before Paul J. Jaroscak,
Judge, and a jury, but the court dismissed the jury and found plaintiff entitled to judgment against defendant Motor Vehicle
Casualty Company up to the limit of its policy and against Universal Underwriters for any excess. Defendants Motor Vehicle
Casualty Company and Morten Arneson appealed from an order denying their motion for a new trial. AUTHOR: GALLAGHER
