Plaintiff and defendant own adjoining residential properties in Cloquet, Minnesota, described as lots 8 and 9, block 1, Nelsons Addition. Plaintiff, Clarence Alstad, owns and occupies lot 9, which lies south of defendants, John Boyer, lot 8. Both lots front on H street and face east. A concrete paved driveway extends from H street toward the rear of the lots along the boundary line between the premises of the parties. This driveway is ten feet wide, a portion of which width lies upon Alstads property and the remainder upon Boyers property.
